- Main: and it should also be known that it is well established among scholars that the sigheh contract must be performed with the intention of creating a contract. For example, the person who utters the words “I marry” (inkahtu), if the intention is that no marriage has taken place before this, or if the intention is that the marriage is being contracted by the words “I marry” the marriage will in fact take place. Meaning that he is saying “I make this contract now” and the marriage is thus concluded. And know that if the man and the woman perform the marriage contract themselves [without representation] and the woman has no attorney, first the woman says “I marry to (inkahtu) and betroth (zawwajtu) myself to you with a known and aforementioned dowry (saddāq)” and the man says “I accept the marriage to and betrothal for myself with the known and aforementioned dowry”. If the woman has an attorney and a guardian (wali) and she herself says the nika, she should say: “I marry and give myself on the authority (isālatan) and deputyship (wikālatan) of my grandfather and father, for the specified, aforementioned dowry (mahr)” and the man says “ I accept the marriage to and nika for myself for the specified, aforementioned dowry” Margin: The marriage (munākiha) took place between the two parties, the offer and the acceptance. - متن: داشته و ایضا باید دانست که مشهور میان علما انست که صیقه جمع عقود را بقصد انشا واقع می باید ساخت مثلا کسی که تلفظ بلفظ انکحت می نماید اگر [مراد] این باشد که قبل ازین نکاح واقع نمی شود و اگر مراد این باشد که بلفظ انکحت نکاح واقع می سازد یعنی حالا می سازم و باین نحو نکاح واقع می شود و بدانکه اگر مرد و زن هر دو خود مرتکب صیغه شوند و زن وکیل نداشته باشد و اول زن بگوید انکحت و زوجت نفسی لک علی الصداق المعلوم المذکور و مرد بگوید قبلت النکاح و التزویج لنفسی علی الصداق المعلوم المذکور و اگر زن وکیل و ولی داشته باشد و خود صیقه بگوید چنین بگوید که انکحت و زوجت نفسی اصالة و وکالة عن جدّی و عن ابی بالمهر المعلوم و مرد بگوید قبلت النکاح و التزویج لنفسی بالمهر المعلوم حواشی: قد وقعت المناکحه بین طرفی الایجاب و القبول و انا من جانب الایجاب ... حزن؟ اول السادات ... ۲ روی النبی صلی الله انه نهی و التطلیق و التطویق و التطیعق دست برو افکندن - سرش افکندن - در هوا نگریدن؟ و التطبیق و التطمیق دست در میان زانو نهادن - چشم برهم نهادن و التطریق و التنطیق دست در گردن اوردن – خمیازه کشیدن صدق رسول الله النــــــــــــــاکح فلان ابن فلان الوکیـــــــــــــل فلان ابن فلان المنکوحـــــــــه فلان بنت فلان الوکیــــــــــــلها فلان ابن فلان بصداق التاریخ ؟؟ تومان - ۲ شهر فلان ۱۱۰۳ [پارگی] مباحات؟ محل مهر
